This privacy policy (“Policy”) explains our policy regarding the collection, use, disclosure, and transfer of your information, personal or otherwise, by Fliksoft Technologies Private Limited or any of its affiliate(s) (“we” or “us” or “our”), which operates the website https://fliksoft.com ("Site"), “App Name” (the “App”) available on Google Play Store, iOS and other similar platforms and other Services. The App and the Site are jointly referred to as “Platforms” and individually as “Platform”).

The terms “you” and “your” refer to the user of the Platforms. The term “Service(s)” refers to any Service offered by us on our platforms or otherwise and would include any other future services we may provide or propose to provide.

As we update, improve and expand the Services, this Policy may change, so please refer back to it periodically. By accessing the Platforms or otherwise using the Services, you expressly and fully consent to the collection, storage, transfer, and/or use of the personal information you provide (including any changes thereto as provided by you from time to time) for any of the services offered by us or any of our group entities, or affiliates, in accordance with this privacy policy.

We recognize the importance of maintaining your privacy. We value your privacy and appreciate your trust in us. This Policy applies to current and former visitors to our Platforms and to our online customers. By visiting and/or using our Services, you agree to this Policy. If you do not agree with any term in this Policy, please do not use/avail of our Services.

Information we collect:

Personal and Sensitive Personal Information collected includes but not limited to:

  • Name, age, gender, user’s photo, phone number, e-mail id, payment info, contacts.
  • App interactions where information about how the user interacts with the app. For example, the number of times they visit a page or sessions they tap on.
  • Installed apps - the information about the apps installed on the user’s device.
  • Identifiers that relate to an individual device, browser or app.
  • App information - Crash log data from your app and the Information about the performance of your app.
  • UGC - Any other user-generated content not listed here, or in any other section.
  • PAN card number, KYC related information such as videos or other online/ offline verification documents. Aadhaar information including Aadhaar number or Virtual ID for the purposes of e-KYC authentication with the Unique Identification Authority of India (UIDAI).
  • We collect information if you post a comment on our Platforms, websites or ask us a question through phone or email. We use tracking tools like Google Analytics, Google Webmaster, browser cookies and web beacons for collecting information about your usage of our Platform.
  • We use information to respond to your requests or questions. We might use your information to confirm your order or purchase or specification for your typical need(s).
  • We use information to improve our products and services. We might use your information to customize your experience with us. This could include displaying content based upon your preferences.
  • We use information to look at Platform trends and customer interests. We may use your information to make our Platforms and products better. We may combine information we get from you with information about you we get from third parties.
  • We use information for security purposes. We may use information to protect our company, our customers, or our Services.
  • We use information for marketing purposes. We might send you information about special promotions or offers. We might also tell you about new features or products. These might be our own offers or products.
  • We use information to send you transactional communications. We might send you emails or SMS or GCM notification about your account.

Any information provided by you will not be considered as personal information if it is freely available and/or accessible in the public domain or is not deemed as a personal information under the applicable law. Further, any reviews, comments, messages, blogs posted/uploaded/conveyed/communicated by you on the public sections of the Platform or an application store (like the App Store or Play Store) becomes published content and is not considered as personal information which is subject to this Policy.

In case you choose to decline to submit information our Platform, we may not be able to provide certain services on the Platform to you. We will make reasonable efforts to notify you of the same at the appropriate time. In any case, we will not be liable and or responsible for the denial of certain services to you for due to not receiving necessary information from you.

Use of your personal information:

  • We use information to contact you. We might use the information you provide to contact you.
  • We use information to respond to your requests or questions. We might use your information to confirm your order or purchase or specification for your typical need(s).

Sharing of information with third parties:

We may transfer / share information (personal and non-personal) provided to us by you with another Fliksoft group / corporate entities or affiliates, to the extent required for the purposes of

  • (i) providing you with the Services on the Platforms or for the purposes of developing and providing you with new services, products and/or new applications which may be developed by us, our group entities or our affiliates,
  • (ii) our internal business and/or administrative purposes, and/or
  • (iii) general corporate operations and to any third-party service providers including marketing partners, and you hereby consent to the same. We will take reasonable steps to ensure that these third-party service providers are obligated to protect your personal information and are also subject to appropriate confidentiality/non-disclosure obligations and they comply with the applicable provisions of the data protection laws.

Aadhaar authentication process by submitting Aadhaar information to Central Identities Data Repository (CIDR) and National Securities Depository Limited (NSDL).

Complying with applicable laws as well as meeting the Know Your Customer (KYC) requirements as mandated by various regulatory bodies, whose regulated service/product you opt through our services/Platforms

Completing a payment transaction initiated by you on a merchant site, where based on your instructions, the merchant requests to fetch your Personal Information from us.

Services related to communication, marketing, data and information storage, transmission, security, analytics, fraud detection, risk assessment and research.

Please note, information collected from you may be processed in or accessed from India or jurisdictions outside of India by members of Fliksoft group entities and categories of third parties in a jurisdiction that do not have equivalent data protection laws to those in India for the purpose outlined above. These group entities and affiliates with whom such information is shared may market to you as a result of such sharing unless you are explicitly opt-out.

Further, we may share the information provided to us by you with third parties such as Fliksoft group entities, affiliates, service providers, customers, or business partners. This may be done in order to provide you access to Services and products offered by us; to collect payments from you; to facilitate our marketing and advertising activities; to comply with our legal obligations etc.

We may share information if we think we have to in order to comply with the law or to protect ourselves. We will share information to respond to a court order or subpoena. We may also share it if a government agency or investigatory body requests as per law. Or we might also share information when we are investigating potential fraud.

In the event that we are involved in a merger, acquisition, bankruptcy, change of control, or any form of sale of some or all of our assets, your information may be transferred or disclosed in connection with such business transactions.

We may share your information for reasons not described in this Policy. We will tell you before we do this.

You can opt-out of receiving our marketing emails. To stop receiving our promotional emails, please unsubscribe by visiting http://fliksoft.com/contact-us.php . Even if you opt out of getting marketing messages, we will still be sending you transactional messages through email and SMS about your purchases or orders.

Third party sites:

If you click on one of the links to third-party websites, including links to websites or applications of Fliksoft group entities or affiliates, you may be taken to websites or applications we do not control. This Policy does not apply to the privacy practices of those websites. Read the privacy policy of other websites carefully. We are not responsible for these third-party sites.

Accessing and updating personal information:

When you use the Platform, we make good faith efforts to provide you, as and when requested by you, with access to your information and shall further ensure that any personal information or sensitive personal data or other information found to be inaccurate or deficient shall be corrected or amended as feasible, subject to any requirement for such personal information or sensitive personal data or information to be retained by law or for legitimate business purposes. We ask you to identify yourself and the information requested to be accessed, corrected or removed before processing such requests, and we may decline to process requests that are unreasonably repetitive or systematic, require disproportionate technical effort, jeopardize the privacy of others, or would be extremely impractical (for instance, requests concerning information residing on backup tapes), or for which access is not otherwise required. In any case, where we provide information access and correction, we perform this service free of charge, except if doing so would require a disproportionate effort. Because of the way we maintain certain services, after you delete your information, residual copies may take a period of time before they are deleted from our active servers and may remain in our backup systems.

Information storage and backup:

From time to time, we take backup of your data. This is done to provide you reliable service in case of any data loss.

We shall keep your information in our records till the period of time where we can potentially offer our Services. After such a period of time where our Services are no more relevant to you, we remove all the information pertaining to you from our records.

Information security:

We take appropriate security measures to protect against unauthorized access to or alteration, disclosure or destruction of data including accidental or intentional manipulation, loss from access by unauthorized parties. These include internal reviews of our data collection, storage and processing practices and security measures, including appropriate encryption and physical security measures to guard against unauthorized access to systems where we store personal data. All information gathered our platform is securely stored within the controlled database. Access to the servers is password-protected and is strictly limited.

Please note that withdrawing consent does not affect our right to continue to collect, use and disclose personal information where such collection, use and disclose without consent is permitted or required under applicable laws.

This Policy was last updated on 22nd Sept, 2022. From time to time we may change our privacy practices. We will notify you of any material changes to this Policy as required by law. We will also post an updated copy on our website. Please check our Platforms periodically for updates.

Jurisdiction:

If you choose to visit the Platform, your visit and any dispute over privacy are subject to this Policy and the Platform terms of use. In addition to the foregoing, any disputes arising under this Policy shall be governed by the laws of India.
